Credit License on Construction Sites: A New Obligation for Workplace Safety

From 1 October 2024 , the mandatory credit license for construction companies and self-employed workers operating on temporary or mobile construction sites comes into force. This system, introduced by Legislative Decree 19/2024 (PNRR Decree 4) and included in the new Article 27 of the Consolidated Law on Safety , aims to improve safety at work and reduce accidents.

Who Should Get a Credit License?

The driving licence is mandatory for anyone carrying out construction, maintenance, repair and demolition activities, as indicated in Annex X of Legislative Decree 81/08 .

Who is exempt?

  • Companies with SOA certification (classification ≥ III);
  • Anyone who provides exclusively intellectual services.

Foreign workers must present an equivalent document issued by their country of origin.

How to Get a Driving License?

The request is made through the National Labor Inspectorate portal , using SPID or CIE . It is not necessary to attach documents, but only to self-declare the required requirements.

Requirements for obtaining

  • Registration at the Chamber of Commerce;
  • Mandatory training for employers and workers ( art. 37 Legislative Decree 81/08 );
  • Single Document of Contribution Regularity ( DURC );
  • Risk Assessment Document ( DVR );
  • Single Document of Fiscal Regularity ( DURF );
  • Designation of the Head of the Prevention and Protection Service (if applicable).

How Does the Credit License Work?

Each business or self-employed worker starts with 30 credits . Violations result in the deduction of credits, based on the severity:

Violation Deduction
Serious violations ( Annex I Legislative Decree 81/08) -10 credits
Violations that put workers at risk ( Annex XI ) -7 credits
Accident resulting in death -20 credits
Injury resulting in permanent disability -15 credits
Injury with absence > 40 days -10 credits
Lack of training -2 credits

In order to operate on construction sites, you must maintain at least 15 credits . If you fall below this threshold, you risk fines of €6,000 to €12,000 and exclusion from public works for 6 months .

In case of inspections with multiple violations, the maximum reduction is equal to double the most serious sanction . In addition, for serious injuries, the license can be suspended for up to 12 months .

How to Recover Debts?

A decree from the Ministry of Labor will establish the recovery methods, which may include:

  • Specific training courses;
  • Recovery of 1 credit per year up to 10 credits ;
  • 5 credit bonus for companies with advanced security policies .
